Commission Consolidated Jurisdictional Notice under Council Regulation (EC) No 139/2004 on the control of concentrations between undertakings

This Consolidated Jurisdictional Notice ('Merger Regulation') replaces the current four jurisdictional notices, adopted by the European Commission in 1998 under the previous Merger Regulation, Council Regulation No. 4064/89. These are the Notice on the concept of concentration, Notice on the concept of full-function joint ventures, Notice on the concept of undertakings concerned and Notice on calculation of turnover. The consolidated Notice therefore covers all issues of jurisdiction relevant for establishing the Commission’s competence under the new Merger Regulation. The only jurisdictional issue that is not covered by the Notice is for case referrals, which are dealt with by the Commission Notice on Case Referrals.
