Decision No EX-04-1 of the President of the Office of 26 April 2004 adopting Guidelines for the proceedings relating to a declaration of invalidity of a registered Community design
The purpose of this Decision was to adopt the Guidelines for the proceedings relating to a declaration of invalidity of a registered Community design, which explain how, in practice, the requirements of the Regulation on the Community design, the Implementing Regulation and the Fees Regulation will be applied by the Office in the examination of an application for a declaration of invalidity of a registered Community design. The Guidelines assist the members of the Invalidity Division to consistently apply the Regulations to the invalidity proceedings and serve as a guide to the parties concerned. The Guidelines are general in character and cannot be expected to cover all possible situations. These Guidelines will be adapted where necessary to reflect the results of actual experience with invalidity proceedings.
