Proposal for a Council Decision conferring jurisdiction on the Court of Justice in disputes relating to the Community patent

The Proposal discusses the establishment of a Community patent jurisdiction as a key element of the Community patent system. The Community patent title covering the territory of all Member States will not only be governed by the uniform provisions of Community law contained in the regulation of the Council on the Community patent. It will after a transitional period during which national courts will retain jurisdiction for the subject matter, also be enforceable before a Community jurisdiction whose decisions enjoy Community wide effect.
