Draft Agreement on the establishment of a European patent litigation system

This Draft agreement aims to improve the enforcement of European patents, to enhance legal certainty and to promote the uniform application and interpretation of European patent law. It sets up a new international organisation, the European Patent Judiciary (EPJ), to settle litigation concerning the infringement and validity of European patents effective in the Contracting States which commit themselves to this new integrated judicial system. The agreement comprises the Court of First Instance, the Court of Appeal and the Registry.
